TRC has been retained by the LMDC to provide expert environmental consulting services relative to the process of deconstructing 130 Liberty Street. TRC will assist LMDC by providing independent third party expert advise on an as-needed basis during the various phases of the project including but not limited to building condition evaluation, inspection, planning and engineering, permitting, public outreach, execution and oversight of this high profile deconstruction. TRCs has directly relevant experience having worked on numerous high-profile WTC and related projects as summarized below: NYC Law Department – World Trade Center Environmental Consulting Services at 100 Church Street, New York City. 100 Church Street was evacuated after the World Trade Center collapse and was impacted, through building envelope compromises, by contaminants from the WTC dust plume. In order to re-occupy their office space (2nd through 6th floors and the 20th floor), the NYC Law Department contracted TRC to provide a review of the building management response actions, re-occupancy sampling and environmental consulting services. TRC oversaw all aspects of the building assessment, clean-up and post cleanup evaluation related to the NYCLD floors and associated heating ventilation and air-conditioning (HVAC) floors. The assessment and re-occupancy sampling included evaluations for airborne and surface dust concentrations of asbestos-containing material (ACM) dust, respirable silica quartz dust, volatile organic compounds (VOC), polynuclear aromatic hydrocarbons (PNA/PAH), multiple metals (including lead), polychlorinated biphenyls (PCB), polychlorinated dibenzodioxins (PCDD), polychlorinated dibenzofurans (PCDF), respirable and total particulate matter, fungi and bacteria. TRC employed standard sampling methods, including dust wipe, dust microvacuum and air sampling methodologies. TRC reviewed the work of the owner and evaluated the efficacy of their cleaning operations. TRC provided daily oversight, testing and consulting services associated with the building clean–up. TRC staff board certified toxicologist performed a site-specific Human Health Risk Assessments (HHRA) in compliance with USEPA protocols to determine if re-occupancy criteria had been met. TRC was the key presenter in an expert panel of multiple formal presentations to the NYCLD legal and administrative staff prior to and subsequent to re-occupancy. TRC has conducted on-going monitoring activities at the building that have confirmed the re-occupancy assumptions and recommendations were appropriate. Cleary, Gottlieb, Steen & Hamilton – World Trade Center Environmental Consulting Services at One Liberty Plaza, New York City. As a result of the WTC disaster, TRC was contracted by Cleary, Gottlieb, Steen & Hamilton (CGS&H) to provide environmental consulting services on eight floors (over 300,000 square feet) of One Liberty Plaza in downtown New York, across the street from the WTC site. One Liberty Plaza was evacuated immediately after the attack. TRC performed an environmental evaluation of the CGS&H space for re-occupancy. This evaluation included a multi-media assessment for an extensive list of contaminants of potential concern (COPC). TRC oversaw the cleaning activities, performed post-cleaning testing and evaluations, coordinated the work with the multiple involved parties, inspected the cleaning operations, directed re-cleaning efforts, performed an EPA compliant site-specific Human Health Risk Assessment (HHRA) based upon the results of post cleaning testing and provided recommendations relative to re-occupancy. After TRC’s Environmental Assessment and Human Health Risk Assessment Report was published and accepted, the CGS&H space was reoccupied on December 3, 2001. As part of the employee communication support and based upon report findings, TRC was a key presenter in an expert panel discussion at five (5) CGS&H employee, both legal and administrative staff, conferences related to the environmental re-occupancy efforts. These conferences were described in the Wall Street Journal. The goal of these conferences were to help CGS&H employees understand the level of re-occupancy efforts taken, to communicate the facts about office contamination and conditions and respond to any employee concerns. TRC also provided ongoing environmental monitoring throughout the eight floors of One Liberty Plaza subsequent to re-occupancy. TRC collected air samples of asbestos, total dust, 22 metals and volatiles twice weekly for a period of time until TRC and Client were satisfied that the on-going recovery operations were not impacting the CGS&H space. US Environmental Protection Agency - World Trade Center - Background Conditions Study, New York City. TRC was tasked by the US Environmental Protection Agency (EPA) to assist them in assessing the impacts of possible contamination from World Trade Center (WTC) collapse-related dust in indoor residential environments. To determine the levels of pollutants that existed in indoor residential environments in New York City prior to September 11, 2001, EPA and TRC conducted this study to test the dust in residential buildings that were not directly affected by the collapse. The objective of this background study was to determine indoor baseline levels or background concentrations of Contaminants of Potential Concern (COPC) including asbestos, lead, dioxins, PAHs, silica, calcite, gypsum, and fibrous glass in household dust and asbestos, lead, silica, calcite, gypsum, and fibrous glass in indoor air for New York City residential buildings. Using three-air sampling technician teams, TRC conducted sampling efforts in 14 residential Upper East Side Manhattan buildings known not to be affected by the airborne dusts and plume that emanated from the WTC site. Air, wipe, microvacuum and bulk background samples were collected in each building from two residential units and from one common area in the building, such as the lobby, hallways and/or stairwells. Prior to commencement of the sampling effort, TRC prepared and EPA approved a project-specific Health and Safety Plan (HASP)_and a detailed Quality Assurance Project Plan (QAPP). Upon completion of the sampling effort, TRC documented the project activities in a Background Sampling Report. New York City Department of Health and Mental Hygiene - World Trade Center Expert Environmental Consulting Services, New York City. TRC was retained by the New York City Department of Health and Mental Hygiene (NYCDOHMH) to support their organization in addressing technical environmental and health risk assessment issues related to the World Trade Center (WTC) disaster. TRC performed numerous services including participating as the NYCDOHMH representative on the multi-governmental agency WTC Indoor Air Quality Task Force meetings and providing parties with guidance relative to technical issues. Due to the nature of the services and Con Edison's need, TRC provided a 24-hour, 7-days-a-week onsite presence over a two-week period that began on September 13, 2001. Con Edison relied on the TRC staff of health and safety professionals and engineers, including Certified Industrial Hygienists, Certified Safety Professionals, Professional Engineers, Certified Asbestos Project Monitors, and Certified Asbestos and Lead Investigators/Inspectors on an as needed basis to successfully implement their response. TRC was critical to ensuring Con Edison and their multitude of subcontractors maintained compliance with critical health and safety protocols established dynamically for the project. Legal Aid Society – Human Health Risk Assessment Services – WTC Toxicological Evaluations, 90 Church Street, New York, New York. TRC was retained to provide expert toxicological consulting services to aid a smaller local environmental consulting services firm which did not have the in-house expertise to perform sophisticated data evaluation and human health risk assessments. TRC assisted in complex data evaluation and interpretation in the context of evaluating the building owners response to the significant WTC impact to the building. TRC assisted in risk communication and documentation of conditions within the building. General Electric Corporate Real Estate – WTC Environmental Consulting Services, New York City. TRC was contracted by GE Corporate Real Estate (GE) to provide environmental consulting services at 115 Broadway in New York. Due to the close proximity to the WTC site, the GE space was evacuated on 9/11. TRC performed an environmental evaluation of the GE space, which included visual investigation and sampling to determine if the space is fit for re-occupancy subsequent to cleaning operations. TRC visually inspected the entire GE space and common spaces that GE employees enter in the course of their work in the building. In conjunction with the visual inspection, air sampling was conducted to confirm the cleanliness of the response actions. Sampling and analysis was conducted for Asbestos (TEM analysis), VOCs, SVOCs, Carbon Monoxide, Carbon Dioxide, and Sulfur Dioxide. Battery Park City Authority / CWA Architects - Repair of the Battery Park Seawall, New York City. TRC has been awarded a contract as a structural engineering consultant to CWA Architects. Battery Park City includes approximately ninety-four acres of reclaimed land. Due to impacts from the World Trade Center collapse and subsequent emergency response activities, the perimeter sea wall of said land suffered structural damage. The damage occurred at various locations of the approximately one mile long sea wall along the esplanade on the Hudson River. TRC was contracted to assess the structural damage and prepare specifications and plans for the repair of the perimeter sea wall. This work was part of the first phase of the contract. TRC has also provided construction phase oversight support assignments. York Hunter Construction Services - Board of Education Emergency Inspection, New York City. York Hunter Construction Services retained TRC Engineers, Inc. to perform fast-track inspection of two schools in lower Manhattan to determine if there were any structural integrity or safety issues as a result of the WTC collapse. TRC mobilized an inter-disciplinary team of architects and structural engineers who conducted the inspections of PS124 and PS126. TRC provided a preliminary assessment to York Hunter and the Board of Education by the end of the day and immediately followed up with a detailed engineering report. TRC's inspection identified cosmetic damage attributable to the event that was rapidly mitigated. Additionally, other pre-existing conditions were also brought to the attention of the client for future action. Industrial and Technology Cooperation Program - Environmental Consulting Services, New York City. TRC was contracted by Industrial and Technology Cooperation Program (ITAC) to provide environmental consulting services at 253 Broadway in New York. Due to the close proximity, the ITAC space was evacuated after the WTC collapse. TRC performed an environmental evaluation of the ITAC space, which included visual investigation and sampling to determine if the space is fit for re-occupancy subsequent to cleaning operations. TRC visually inspected the entire ITAC space, common spaces that ITAC employees enter in the course of their work in the building, and “hidden” spaces that serve the area including heating, ventilation, and air conditioning and other mechanical spaces. In conjunction with the visual inspection, air sampling was conducted to confirm the cleanliness of the response actions. Sampling and analysis was conducted for Asbestos (TEM analysis) and Metals (NIOSH analysis). TRC Key Personnel Bios Edward Gerdts, CIH, CSP – Mr. Gerdts, Vice President of TRC, has over eighteen (18) years experience in Environmental, Health and Safety consulting services with particular emphasis in building toxics projects. Mr. Gerdts manages TRC’s New York City office and has directed numerous projects in Lower Manhattan that were directly related to the World Trade Center attack. Mr. Gerdts is a Certified Industrial Hygienist (CIH) by the American Board of Industrial Hygiene and a Certified Safety Professional (CSP) by the American Board of Safety Professionals. Mr. Gerdts also possesses a Masters of Science Degree in Environmental and Occupational Health Science. Karen Vetrano, Ph.D. – Dr. Vetrano manages TRC's Health and Safety Assessment Services Group, which is comprised of Risk Assessment and Toxicology, Industrial Hygiene, and Odor Control. Dr. Vetrano holds a Doctorate in Toxicology and has over eleven (11) years of experience in managing and providing technical support for the various components of human exposure and health risk assessments under State and Federal Programs. Gary Hunt, QEP – Mr. Hunt is an air quality expert with over 22 years of air quality and emission experience. He specializes in the characterization, quantification and control of toxic air pollutant emissions. Mr. Hunt is a Qualified Environmental Professional (QEP) who holds a Bachelor’s Degree in Chemistry and a Master’s degree in Environmental Sciences. He is also a member of the Air Quality Impacts Committee for the Water Environment Federation (WEF), a fellow member for the Air and Waste Management Association (AWMA), and a member of the American Chemical Society (ACS), Division of Environmental Chemistry. Robert O. Harris, MPH –Mr. Harris is Senior Vice President of TRC and a public health specialist with over 25 years experience with Environmental and Occupational Health consulting services with particular emphasis on the public health exposure aspects of construction and remediation projects. He currently has overall responsibility for TRC’s First Avenue Project for the asbestos abatement, demolition, decommissioning and remediation of Con Edison’s Waterside Generating Station and 708 Office Building. He is a licensed Public Health Officer and Registered Environmental Health Specialist in the State of New Jersey. He holds a Bachelor’s Degree in Environmental Science Human Ecology and a Master’s of Public Health Degree from the University of Medicine and Dentistry of New Jersey Robert Wood Johnson Medical School. Gary Ritter, LSP, LEP, CIH, CSP, CHMM – Mr. Ritter is the Senior Industrial Hygienist in TRC's Health and Safety Assessment Division. He has more than 24 years of experience in all aspects of environmental health and safety management including industrial hygiene, asbestos and lead abatement, indoor air quality investigations, environmental audits and exposure assessments. Mr. Ritter is TRC's Corporate Health and Safety Director and is responsible for TRC's health and safety programs. His role includes the development and enforcement of these programs throughout TRC's offices. Mr. Ritter is also a Certified Safety Professional, Licensed Environmental Professional, Licensed Site Professional, Certified Industrial Hygienist, Registered Sanitarian, and Certified Hazardous Materials Manager, Master Level. Martin Lewis, CIH, CSP – Mr. Lewis is an environmental health and safety (EHS) professional with over 24 years of experience in all aspects of EHS management including industrial hygiene, indoor air quality, environmental audits and training. He is involved with all types of health hazard assessments with specialty in EHS audits, noise surveys, crystalline silica exposures and machine guarding. Mr. Lewis has in-depth knowledge of OSHA, MSHA, EPA, CPSC, NFPA, ANSI, and ASTM regulations. He holds certification as a Certified Safety Professional and Certified Industrial Hygienist. Gale Hoffnagle –Mr. Hoffnagle is a Senior Vice President and Technical Director at TRC with over 32 years of consulting experience. He specializes in air quality and toxics, meteorology and modeling. He holds a Bachelor’s and Master’s Degrees in Meteorology and Master’s in Business Administration. Mr. Hoffnagle has served as an expert witness in more than 20 environmental matters in 14 states and federal cases since 1973. He specializes in air quality meteorology and modeling, and has testified on fugitive dust issues, air quality permitting issues, regulation development, and Clean Air Act implementation. Marc Wilkenfeld -Marc Wilkenfeld, MD is a Board Certified Occupational/Environmental Physician in New York City. He is an Assistant Professor in Clinical Medicine at Columbia University Medical Center where he also acts as Occupational Medicine Consultant to the Department of Environmental Health and Safety. He has lectured and trained Internal Medicine and Family Practice Doctors on aspects of Occupational/Environmental Medicine. Dr. Wilkenfeld is an attending physician at New York Presbyterian Hospital and Beth Israel Medical Center. Dr. Wilkenfeld has acted as occupational medicine consultant to corporations, government agencies and other organizations in the United States and Europe. He is past-president of the New York Occupational Medicine Association .He has lectured extensively in the field of Occupational and Environmental Medicine Following the attacks on 9/11 Dr Wilkenfeld acted as a consultant to a number of government agencies, corporations and community groups on the environmental health impact of the disaster. In this role he reviewed data and answered questions regarding potential health effects of contamination with WTC dust. He moderated and participated in community forums designed to answer the health questions of residents and workers. He has also evaluated cases of illness related to the 9/11 disaster. DSNY Long-Term Solid Waste Management Program—Public Partici¬pation, New York City. To support DSNY in the permit review process for eight marine transfer station (MTS)/solid waste containerization facilities, the E & E project team developed an enhanced, citywide public involvement program in accordance with city and state requirements. E & E’s outreach services include the preparation of fact sheets and flyers to provide a brief description of the proposed project in an easy-to-read format; development of stakeholder lists; circulation of project-related outreach materials in local newspapers/newsletters and in easily accessible document repositories; translation of outreach materials for non-English dominant languages used by community residents; establishment of a toll free hotline; and coordination of logistics and planning for the scoping and Draft EIS hearings. Astoria Power Plant. E & E supported Orion Power of New York (now Reliant Energy) in its acquisition of certification for the repowering of the newly acquired Astoria power plant in compliance with Article X of the New York State Department of Public Service Law. For this project, the E & E team coordinated and conducted a series of open house meetings, participated in team workshops and pre-meeting preparation and role-playing, prepared a questionnaire to obtain feedback from the public regarding the effectiveness of the meetings and handout materials, and translated the meeting materials in several languages to accommodate a culturally diverse neighborhood. In addition, E & E developed and maintained the project Web site (www.orion.ene.com), which provided continuous updates on the status of activities, identified key contacts and opportunities for public involvement, and pre¬sented information concerning the project schedule. Hudson River PCB Cleanup, New York State. As part of its overall project management and environmental support contract with USEPA, E & E set up and staffs a field office to support the public participation program and authored the community involvement plan. For this project, E & E has supported more than 20 public sessions focusing on a variety of technical topics. To support these sessions, E & E has designed graphic displays, and developed PowerPoint shows, maps and handouts illustrating various activities in the project area. As part of our technical support, E & E developed a set of performance standards to address impacts related to Air Quality, Odor, Navigation, Noise, and Lighting. These standards, developed specifically for this project, establish maximum levels for various potential project impacts and identify monitoring and compliance actions. For over 20 years, E & E has managed and provided full-time staffing of USEPA’s high-profile Public Information Office in Niagara Falls, New York for nationally known hazardous waste sites in Niagara Falls. The office is dedicated to providing citizens with information on environmental topics and the progress of activities at the numerous CERCLA and removal sites located in the Niagara Falls and western New York area. The office facilitates public access to government personnel and other experts for meaningful dialogue affecting decisions that will have long-term community impact. E & E’s staff in the Niagara Falls public information office provides site tours and impromptu briefings for private citizens, community organizations, and school groups; and interaction with public interest groups associated with EPA environmental programs at the federal, state, and local levels. Key Personnel Nermin Ahmad, is director of E & E’s NYC office. She has over 23 years’ experience working with local, state, and federal agencies. Her recent E & E projects include the development and implementation of planning initiatives, including community outreach efforts, for clients such as the NYC Department of Buildings, NYC Office of Emergency Management (NYCOEM), Dutchess County Department of Emergency Response, Erie County Department of Emergency Services, and the City of Buffalo. Julie Chang has nine years’ experience as an economist. She brings to this effort her expertise in emergency management, project management, and public outreach. Located on the perimeter of the World Trade Center site, 90 Church Street was fully gutted due to the variety of contaminants in the building following the collapse of the World Trade Center. Ambient provided consulting, monitoring and laboratory services. Over a period of 25 months, the building underwent survey, specification development, contractor bid process and monitoring of full-building abatement. 1221 Avenue of the Americas, New York City. Located in the heart of Manhattan, the 1221 Avenue of the Americas abatement project required design, bid and project monitoring for multi-floor demolition, abatement and re-fireproofing in an occupied building. The Dorset Hotel, New York City. The Dorset Hotel project include a full building survey, specification development, contractor bid process and monitoring of full building abatement, building demolition and soil excavation for new structure. The URS Team for the deconstruction of 130 Liberty Street includes LandAir Project Resources, Inc. LandAir is a certified WBE and will be providing at least 20% of the services on this project. They bring 11 years of experience and expertise in new construction, rehabilitation, and historic preservation projects for both public and private clients. Development programs for which LandAir has provided owner’s representation and project management services represent over $1.5 billion in value. Most recently they have served as LMDC’s administration consultant for the World Trade Center Memorial Design Competition. Other municipal and government assignments have included work for DASNY, the Empire State Development Corporation, the Division of Housing and Community Renewal, the NYC Department of Design and Construction, the Housing Trust Fund, the City of Yonkers Bureau of Planning and Development, the City of Yonkers Department of Economic Development, the Alliance for Downtown New York, the Brooklyn Public Library. Below are summaries of pertinent experience for the lead personnel of the URS Team. Dominick Fickeria – Project Executive Mr. Fickeria has over 20 years of construction management experience in building facilities. His experience has included the management of projects from a projects initial conception to construction completion. His expertise includes design review, logistics, phasing, scheduling, estimating and construction supervision. Similar projects he has managed included the Decommissioning of the General Motors plant in Westchester County, which included over 3,000,000 sf of building structures throughout a 98-acre complex. Mr. Fickeria was the director of both the preparation of demolition design documents and overall construction management of all operations on this assignment. His most recent assignment was the pre-construction for the US Missions to the UN, this project includes the preparation of documents and phasing operations for the decommissioning, environmental remediation and dismantling of the existing hi-rise structure located at First Ave and 45th St in Manhattan. Other projects have included the selective demolition at the Westchester Courthouse which consisted of the removal of the 20 story tower masonry façade, underground garage structure, utility relocations and plaza area for the Courthouse; this project involved the interior renovation and connection of a new courthouse annex link with significant foundation modifications to the existing 20 story courthouse tower. The project includes over 500,000sf of building space which required extensive phasing and logistics to allow construction within the confines of an occupied Courthouse. Mr. Fickeria brings the seasoned construction management experience required to manage a project of this magnitude. Michael J. Burton, PE – Project Principal Mr. Burton is an engineering executive with 18 years of diverse engineering and construction experience including the start-up of the NYC DDC and management of the engineering and construction operations of the World Trade Center disaster site. He was responsible for the demolition of over 15 million square feet of office space, perhaps the largest demolition and remediation project in the country. Mike has managed a staff of 1300 design and construction professionals with a portfolio of 1,259 projects valued at more than $4.1 billion. His special areas of experience include the establishment of excellent working relationships with government agencies and their staff. As the Executive Deputy Commissioner with the NYCDDC, Mr. Burton was responsible for the day-to-day operations of the Agency that designs and builds the majority of New York Cities public buildings, roads, water and sewer projects and has been involved in dozens of demolition projects. Jaime Daniels – Project Manager Mr. Daniels has over 25 years experience in Construction Rehabilitation, Renovation and Construction of Various Buildings. He has served as Construction Manager, Project Manager and General Superintendent overseeing the rehabilitation and renovation of various facilities in New York. Included are such properties as the World Financial Center, American Express, Dow Jones and Merrill Lynch’s World Headquarters. Historic gut renovation of Carnegie Hall and the 31 story Art Deco Alfred E. Smith Building. Various other renovations include the 32-story Heron Tower Condominiums and the mixed-use Citispire Condominiums. He has prepared and maintained construction schedules, developed budgets, prepared job estimates, evaluated and analyzed bid documents and specifications, negotiated contracts and contract changes. Mr. Daniels was also part of Mr. Fickeria’s team for the Decommissioning of the General Motors plant in Westchester County. Robert “Len” Tempest – Assistant Project Manager (LandAir) Mr. Tempest is a licensed architect with over 20 years experience in public, non-profit and private sector project development. His background includes renovations to existing properties, large scale new construction and facilities management. Mr. Tempest brings formidable analytical skills, combined with a well-rounded perspective of technical planning and oversight of facilities development. John Eget – Environmental Specialist Mr. Eget has over 16 years of environmental assessment, abatement and management consulting experience. His broad base of environmental experience includes environmental assessments, asbestos, lead-based paint, and construction management services throughout New York City. Notable New York City project experience includes: the General Motors Building, 200 Park Avenue, F.A.O. Schwarz, Nabisco, General Electric, Metropolitan Life Insurance Co., and 45 Wall Street. Samuel DeFranks – Logistics / Estimating Mr. DeFranks has over 20 years of progressive experience and responsibility with documented success in the area of multi-phase project management, estimating, project scheduling, contract negotiations, personnel and heavy equipment management, subcontractor coordination, scheduling, cost control. He is an expert in the fields of demolition and environmental remediation operations. He has demonstrated the ability to work effectively with various clients simultaneously. Mr. DeFranks is a hands on manager providing demolition, environmental remediation, redevelopment and general contracting services to private and public sector clients through out the United States. Jeffrey Chaisson – Project Controls / Scheduling Mr. Chaisson has over 10 years experience in the Project Controls Management Industry specializing in document controls, scheduling and cost engineering. Mr. Chaisson has prepared joint bid packages for numerous City Agencies. Additionally, his experience includes the analysis of NYCDDC bid packages, project controls, financial project status reports and has supervised numerous renovation and demolition projects. Experience Relevant to 130 Liberty Street Deconstruction ASSEMBLY PLANT DECOMMISSIONING AND DEMOLITION – Demolition URS provided design and construction management services for the decommissioning and demolition of this three-million-square-foot automotive assembly plant, which is located on the banks of the Hudson River for a private commercial client. The facility is situated on approximately 100 acres in Westchester County, New York. The project included demolition of the existing structure, plant infrastructure, automotive assembly equipment, and supporting systems. URS’s scope of services is comprehensive consisting of both design and construction management. Duties included project management, resident engineering, construction inspection, office engineering, CPM scheduling services, cost estimating and other related services. The facility had been an active industrial site for over 100 years, and had been a cornerstone of the region’s economic development in this time. Its location on the shore of the Hudson river in a community of historic significance, made this a very high profile project. URS worked closely with the client to facilitate the requirements of the Demolition Program and coordinate them within the client’s organization. In order to proceed with demolition, URS performed a complete facilities assessment which identified all the sites conditions within the facility. URS provided oversight to support the client’s staff on the closing of the plant, and produced a comprehensive set of bid documents which URS used with the client to hire contractors to perform the work. The Demolition Program also includes some reconstruction of retaining structures that are necessary to support adjacent community property to the site. ALFRED E. SMITH OFFICE BUILDING, ALBANY, NY – Demolition, Hazardous Material Management URS, in joint venture, is providing construction management services for the complete renovation of the historic Alfred E. Smith State Office Building in Albany, NY. The building, which is Art Deco styled, was constructed in 1930 and is listed in the National Register of Historic Places. It is a 31-story, steel frame, limestone veneer building located on a constricted site adjacent to residential and governmental buildings. The rehabilitation involves a total interior gut renovation, exterior cleaning, and window and roof replacements. The total construction cost is estimated at $80 million. Key coordination issues exist due to the nature of the building and site constraints, including: historic preservation/restoration, hazardous materials management, construction staging, local labor issues, existing building systems demolition, accessibility, and local traffic impacts. The design and construction phase services, include project management, contract administration, cost estimating, CPM scheduling, design review, constructibility review, construction staging and phasing, bid and award support, construction administration, construction inspections, cost and schedule control, change control, and other services as may be required. US MISSION TO THE UNITED NATIONS – Hi-rise Deconstruction URS has provided pre-construction phase construction management services for the demolition of the existing steel and concrete hi-rise structure located across the street from the United Nations. The project includes the demolition of over 120,000 sf structure that included the remediation of hazardous materials such as lead and asbestos containing materials. The contract documents were prepared to utilize a comprehensive recycling waste management program to optimize the structures original materials. Also, careful planning was required to provide the use of existing foundation wall systems to assist in structurally supporting the surrounding sidewalk and roadways that will be active during demolition operations, and will be necessary to remain in place while the new structure is constructed. Services included document review, preparation of cost estimates, scheduling, phasing, and the preparation of bid documents and contract language. STIER ANDERSON, LLC FIRM PROFILE Several members of the firm are former federal and state prosecutors with experience dealing with fraud, waste and abuse and organized crime, particularly in the labor/construction area. Together with a team of highly qualified accounting, investigative and engineering professionals, Stier Anderson can help to provide its clients with assurance that they will not be victimized by unscrupulous contractors, illegal or unfair business practices and that construction projects will be performed in compliance with applicable laws and regulations. The firm's emphasis on integrity assurance services began in 1983 when Edwin Stier was retained by GPU Nuclear Corporation to conduct an independent investigation at its Three Mile Island Nuclear Generating Station. In 1991, Stier Anderson was the first firm to be pre-qualified and engaged at the direction of the New York City School Construction Authority as a moinitor for school construction projects. Since that time, the firm has been engaged to provide monitoring services in a number of settings. Most recently the firm was retained on behalf of the New York City Department of Investigation to monitor one of the four prime contractors responsible for managing the World Trade Center (“WTC”) Recovery and Cleanup Project. In between these events, the firm has served in a monitor capacity in a number of cases on behalf of the New York City School Construction Authority, the New York State Organized Crime Task Force and the New York City Department of Investigation. These engagements have allowed the firm to develop the unique legal, forensic accounting and investigative skills required of an Integrity Monitor, particularly in the area of the construction business in New York City. KEY STAFF BIOGRAPHIES Edwin Stier was a Federal and New Jersey State prosecutor for more than 17 years before entering private practice in 1982. While a prosecutor, he specialized in highly complex white-collar crime, organized crime, and corruption investigations. He served as Chief of the Criminal Division of the New Jersey U. S. Attorney's Office. During his last five years of government service, Mr. Stier was Director of the New Jersey Division of Criminal Justice, the nation's largest state-level prosecutorial agency. After leaving public office in 1982, Mr. Stier adapted his investigative procedures to non-criminal investigations that require high standards of thoroughness and precision. It was at this time that Mr. Stier was retained as special counsel by GPU Nuclear Corporation to conduct an investigation at its Three Mile Island Nuclear Generating Station. Since then, Mr. Stier has conducted and supervised investigations for corporations throughout the country. The issues covered by those investigations have ranged from potentially criminal conduct by high-level managers to regulatory and procedural violations. In 1987, Mr. Stier was appointed by the U.S. District Court as trustee for Teamsters Local 560, the first union placed in trusteeship as a result of a RICO action brought by the U.S. Department of Justice. His task was to reform the union after thirty years of organized crime control. In 1999, with the concurrence of the U.S. Department of Justice, Federal Bureau of Investigation, and Department of Labor, the court determined that Mr. Stier’s efforts had been successful in removing organized crime and reforming the culture of the union and terminated the trusteeship. As a result of the success he achieved at Local 560, in July 1999, Mr. Stier was retained as independent counsel by the International Brotherhood of Teamsters to lead an effort throughout the union to achieve similar cultural reforms and to assure that the union is resistant to systemic organized crime and corruption. (See the Work Sample Appendix for a copy of the report detailing the past and present connection between the IBT and organized crime). Gerard K. Frech has been engaged in the private practice of law for 25 years, concentrating on special counsel investigations, integrity monitorships, corporate compliance and civil trial matters. Mr. Frech has been conducting special counsel investigations since 1983, when he and Edwin Stier investigated allegations of misconduct at the Three Mile Island Nuclear Generating Station for GPU Nuclear Corporation. Since 1991, he has also been involved in the development, implementation and oversight of corruption prevention programs for companies engaged in the construction of schools in New York City and for a major international air freight company. Mr. Frech headed the firm’s activities as an Integrity Monitor at the World Trade Center, overseeing one of the four construction management companies responsible for the cleanup and recovery operations there, and preventing organized crime from exploiting the tragedy and assuring that all contractors complied with financial, environmental and contractual requirements. Mr. Frech also serves as the firm’s Managing Member. Michael I. Bixon has conducted and supervised independent investigations for various organizations, including an international labor union, public companies, and a not-for-profit corporation. These matters have included allegations of fraud, corruption, harassment, and discrimination. From 1990 to 1999, Mr. Bixon was an Assistant District Attorney with the Manhattan District Attorney’s Office. From 1996 -1999, he served in the Construction Industry Strike Force/Labor Racketeering Unit where he was responsible for the investigation and prosecution of matters involving corruption in the construction industry, in conjunction with local, state and federal law enforcement agencies. In this regard, Mr. Bixon was responsible for the investigation and prosecution of corruption at municipal union District Council 37, its constituent locals, and the District Council for NYC and Vicinity of the United Brotherhood of Carpenters and Joiners of America. Mr. Bixon also conducted investigations into labor extortion and prevailing wage violations. |
